Section 01

About These Terms

These Terms of Use govern your access to and use of ÉclaireSkin ("the Service"), an AI-powered skincare guidance tool available at eclaireskin.com. By using the Service, you agree to be bound by these Terms.

ÉclaireSkin is operated by its founder ("we", "us", "our"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. The date at the top of this page reflects the most recent update.

Section 02

Minimum Age — 16

If you are between 16 and 18 years of age, you confirm that you have the consent of a parent or legal guardian to use the Service and to agree to these Terms.

We do not knowingly collect personal information from users under the age of 16. If you believe a person under 16 has used the Service, please contact us at hello@eclaireskin.com.

Section 03

Your Account & Skin Profile

You do not need to create an account to use the core features of the Service. Your skin profile data is stored on your device only and is not transmitted to or held on our servers.

You are responsible for the accuracy of the information you provide. Inaccurate profile information may affect the relevance of guidance provided.

If you choose to share your email address for waitlist or notification purposes, we will handle that data in accordance with our Privacy Policy.

Section 04

Subscriptions & Payments

Free tier

Core features are available at no charge, subject to usage limits described in the Service (for example, three ingredient checks per month).

Premium tier

Premium features are available on a paid subscription basis. Pricing is displayed in New Zealand Dollars (NZD) and is subject to change with notice. By subscribing, you authorise us to charge the applicable fee to your nominated payment method on a recurring basis.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods unless required by applicable law.

Consumer rights

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (New Zealand). If a subscription service fails to meet the guarantee of acceptable quality, you may be entitled to a remedy under those Acts.

Section 05

AI-Generated Content

The guidance, observations, and recommendations provided by ÉclaireSkin are generated by artificial intelligence — specifically via the Claude API provided by Anthropic. All AI-generated content is clearly labelled within the Service.

We do not warrant that AI-generated content will be error-free, uninterrupted, or free from inaccuracies. See our Disclaimer for full detail on the limitations of the Service.

Section 06

Product & Ingredient Recommendations

Where the Service suggests product lines or ingredient types, these suggestions are:

• Personalised to the skin profile and brands you have specified
• Based on ingredient type and general suitability — not on brand relationships, commissions, or advertising
• References to product lines (e.g. "the CeraVe hydrating range"), not specific product SKUs

ÉclaireSkin does not accept advertising revenue, affiliate commissions, or payment from any brand. Recommendations are not influenced by any commercial relationship. Product formulations change and regional availability varies — always check the current label before use.

Section 07

Photos You Upload

When you upload a photo for skin analysis, that photo is processed via the Anthropic Claude API to generate your observations. Photos are not stored on our servers after processing.

By uploading a photo, you confirm that:

• You are the person depicted in the photo, or you have the right to upload it
• You consent to the photo being processed by the Service for the purpose of generating your skin analysis

Do not upload photos of other people without their consent, or photos depicting minors.

Section 08

Acceptable Use

You agree not to use the Service to:

• Attempt to circumvent any usage limits or access controls
• Reverse-engineer, scrape, or extract data from the Service
• Use the Service for any unlawful purpose
• Impersonate another person or provide false information
• Upload photos of individuals without their consent

We reserve the right to suspend or terminate access to the Service for users who breach these Terms.

Section 09

Intellectual Property

All content, design, code, and branding associated with ÉclaireSkin — including the É letterform logo — is owned by or licensed to us. You may not reproduce, copy, or distribute any part of the Service without our prior written permission.

Your skin profile data, photos, and personal information remain yours. We claim no ownership over data you provide to the Service.

Section 10

Privacy

Your privacy is important to us. Our Privacy Policy explains how we handle your personal information. Key commitments:

• Skin profile data is stored on your device only — not on our servers
• We do not sell personal data
• We do not use personal data for advertising profiling

Section 11

Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranty of any kind, express or implied
• We are not liable for any loss or damage arising from your use of or reliance on AI-generated guidance
• We are not liable for any adverse reaction to a product or ingredient referenced in the Service
• Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including under the Consumer Guarantees Act 1993 where the Service is acquired for personal or household use.

Section 12

Governing Law

These Terms are governed by the laws of New Zealand. Any dispute arising under these Terms will be subject to the non-exclusive jurisdiction of the New Zealand courts.
